By creating an account, downloading, or using Whyspr, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.

If you do not agree with any part of these terms, you must not use our services.

3.1 Account Creation

• You may register using an email address or Google OAuth
• You must provide accurate and complete information
• You are responsible for maintaining account confidentiality
• One person may only maintain one account at a time

3.2 Account Security

• You are responsible for all activities under your account
• Notify us immediately if you suspect unauthorized access
• We are not liable for losses due to unauthorized use of your account
• Do not share your login credentials with anyone

5.1 Profile Photos

• Photos must be of you and show your face clearly
• No nudity, sexually explicit, or suggestive content
• No photos of children, even if they're your own
• No copyrighted images you don't have rights to use
• No promotional or commercial content

5.2 Messages and Communications

• Keep conversations respectful and appropriate
• Do not share personal contact information prematurely
• Respect when someone declines to continue a conversation
• Report abusive or inappropriate messages immediately

5.3 Room Communications

• Keep room discussions relevant and respectful
• Room creators are responsible for moderating content
• Follow room-specific rules set by creators
• We reserve the right to monitor and remove inappropriate rooms

Whyspr requires access to your location to function. By using the app:

• You consent to location tracking while the app is active
• You understand that your approximate distance is visible to nearby users
• You can control your visibility duration (30 minutes to 4 hours)
• You can set yourself as invisible at any time
• You may not use VPNs, GPS spoofing, or location manipulation tools

8.1 Our Rights

All Whyspr branding, logos, designs, and app functionality are owned by Whyspr and protected by intellectual property laws.

8.2 Your Content

• You retain ownership of content you upload (photos, messages)
• You grant us a license to use, store, and display your content as necessary to provide our services
• You represent that you have rights to all content you upload
• We may remove content that violates these terms

9.1 Your Right to Terminate

• You may delete your account at any time through app settings
• All your data will be permanently deleted within 30 days
• Deletion is permanent and cannot be undone

9.2 Our Right to Terminate

We reserve the right to suspend or terminate your account if:

• You violate these Terms of Service
• You engage in prohibited conduct
• We receive reports of inappropriate behavior
• We suspect fraudulent or illegal activity
• You are under 18 years old
• Your account has been inactive for an extended period

Termination may be immediate and without prior notice in cases of serious violations.

Limitation of Liability

To the maximum extent permitted by law, Whyspr and its affiliates shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of profits, data, or opportunities
• Actions or conduct of other users
• Unauthorized access to your account
• Service interruptions or technical issues
• Reliance on any information provided through the app

You agree to indemnify and hold harmless Whyspr, its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from:

• Your use of the app
• Your violation of these Terms of Service
• Your violation of any rights of another person
• Content you post or share through the app

Your use of Whyspr is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.

By using Whyspr, you consent to our data practices as described in the Privacy Policy.

We reserve the right to modify these Terms of Service at any time. When we make changes:

• We will update the "Effective Date" at the top of this page
• We will notify you via email or in-app notification
• Continued use of the app after changes constitutes acceptance
• If you disagree with changes, you must stop using the app

14.1 Informal Resolution

Before filing any formal dispute, please contact us at support@whyspr.app to attempt to resolve the issue informally.

14.2 Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.

14.3 Arbitration

Any disputes arising from these Terms or your use of Whyspr shall be resolved through binding arbitration, except where prohibited by law.

Severability: If any provision of these Terms is found invalid, the remaining provisions will continue in full effect.

No Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

Entire Agreement: These Terms, along with our Privacy Policy, constitute the entire agreement between you and Whyspr.

Assignment: You may not assign or transfer these Terms. We may assign our rights and obligations without restriction.
